PHOTOGRAPHY CONTRACT TERMS & CONDITIONS

OIWNERSHIP

You will own all of the work we do at your wedding in high resolution and at no extra cost to you. The studio reserves the right to utilize any of your images from any part of your event for marketing and promotion materials. We will post images from your wedding on our social sites and our business web site for promotional purposes unless you specifically tell us otherwise. 

TIME

We will arrive at your getting ready location at the agreed time before your ceremony at which time our time commitment will begin. We will depart your reception only with your permission at the time agreed or a reasonable time thereafter. GAPS OF TIME between your ceremony and reception are part of the time calculation. You may purchase additional time if you wish. I WILL REQUIRE A SPECIFIC RECEPTION SCHEDULE from your DJ/Band in order to maintain things organized and on schedule - this will in most instances cancel the possibility of additional charges for time overages and give you great peace of mind. 

DEPOSIT A non-refundable deposit as stated above is required to book your event. This amount applies to the total amount charged and it's used to hold your date exclusively for you. We book a maximum of three weddings per day. You will be assigned one of our skilled, experienced and courteous photographers not an assistant, trainee or a contractor. All events are booked on a first-come-first-served basis.

BALANCE AND DELIVERY

After your deposit, the balance for your photography will be due as follows: 

33% of balance due 90 days before your wedding. 33% of balance due 60 days before your wedding. The remaining 33% will be due on or before your wedding day. We may book a different event if your balance has not been paid in full by the due dates. 

These are standard guidelines but other arrangements can be made based on your preference.

DELIVERY

Your final high resolution images containing the NET CAPTURED IMAGES will be delivered on digitally (on the cloud) 3 to 5  business days after your event. May, June, September and October may experience longer times due to higher volume. Your products package (when applicable) will be delivered FOUR TO SIX WEEKS following your high resolution images.  Video will be delivered between 6 and 8 weeks.

LIABILITY STATEMENT

Natural Touch Photography is a professional photography studio that has extensive hands on experience and knowledge in using sophisticated photographic equipment to create professional photographs that are above standard or amateur snapshots. The end result however, can be open to interpretation or critique by you or other parties based on personal preferences or taste. Natural Touch Photography is not responsible for such opinions or critique. The photographer photographing your wedding has in excess of five years experience in the wedding industry and has shot many weddings on his/her own. Results may vary based on the particular conditions of your wedding such as time allowed for photos, light sources, location, willingness of groups to work with us and so on. We do not use Craig's List photographers, or trainees or assistants. Photography is an art and therefore it is open to many possible opinions and interpretations generated by many possible variables and emotions. Natural Touch Photography reserves the right to offer its services to any party and may refuse to perform work under certain circumstances. 

In case of major and serious unforeseen circumstances and your photographer is unable to attend your event, Natural Touch Photography will make arrangements for your event day that may include partial and time restricted coverage or it will replace your photographer by a network photographer or photographer in training and provide a partial refund to you. 

We will call you on the week prior to your event however, IT IS YOUR RESPONSIBILITY TO CONTACT US ON THE WEEK PRIOR TO YOUR EVENT IN CASE WE HAVE NOT DONE SO ALREADY - IF WE HAVE NOT CALLED YOU SOMETHING OR NOTHING MAY BE WRONG. WE ENCOURAGE A HIGH LEVEL OF MUTUAL COMMUNICATION PREFERABLY OVER THE PHONE OR IN PERSON ESPECIALLY IF TIMES OR LOCATIONS OR THE DETAILS OF YOUR EVENT CHANGE.

MISCELLANEOUS ITEMS THAT WILL APPLY TO YOU:

· We do not work off of a list of shots or ideas from other photographers or web sites. We can accommodate certain requests, but it is encouraged that the photographer is allowed to use his/her experience and creativity as much as possible. It is yourresponsibility to make us aware of special guests, family reunion type groups or special shots you may want. 

· We never depart your reception without your permission but we suggest you schedule us for a maximum of 2.0 hours - ask us why please. 

· Family and friends photography is welcomed but not necessary since you will have full ownership of all images. We are not responsible for images that are over exposed or that have people looking a different direction due to the presence of other photographers. 

· There is not a limit to the images we will capture or additional charge. We net approximately 50-75 images / hr but more is not necessarily better. We always focus on quality - not quantity. 

· Additional wedding albums will be sold at our cost of $182 based on size and brand 

(Price includes album plus editing and production time, plus shipping and it is not marked up at all)

-Photographer(s) require a place setting at your reception and the same menu as your guests

· We only accept Visa or Master Card - A 3% fee is charged to process any credit card payment

· We are not responsible for reception photos in album of persons that you do not recognize

· You will be responsible for choosing, sorting and submitting the images you would like us to use in enlargements, albums or other products - in the format requested - when applicable. 

· Copyright letter will be provided at your request

· Promotions cannot be combined with any other past present of future discouns or specials.

· All promotions may end without notice and can be changed at any time. A contract must be in place to lock promotional prices

· You may make periodic payments as it is convenient for you but these are not required

· Studio will contact couple on or before the week of your event – you are also responsible to place a follow up call in the event that a call is not received and verify event and times

· Cancellations of less than four months from wedding date will be billed full amount of booking. Postponements within three months of wedding date will require a new deposit.

· All purchases must be charged the applicable New Mexico sales tax of 7.825%

· Primary formal photo session sites are selected by studio – other locations are at client’s discretion and we are not responsible for results due to time spent away from top locations, lighting or background. You MUST allow HALF HOUR for photos at the wedding venue for family photos, and one hour at each offsite venue (excluding travel time). You must ensure you plan your formal photos well in advance of the end of daily natural light which is one hour before the official sunset time.

· Your photographer will photograph your ceremony and reception but we may utilize a different experienced and trained- photographer to photograph your getting ready and/or reception. We never utilize untrained photographers or "photographers in training".

· We will post on Facebook a set of around 100 of your images following your event - please let us know if you do NOT want us to do this.

· Estimated net image description - A net image is a unique or nearly unique image resulting from post production purging and editing

· Reviews discount - A print credit will be given once a positive review has posted on Google, Yahoo, Yelp, CitySearch or Ask.

· Communication - I am very prompt and punctual and I follow up well. But if you EVER do not receive a promised email, phone call or follow up you can rest assured that something out of my control has taken place - if this happens PLEASE CALL ME ON THE PHONE! I will resolve any issue with the utmost urgency. 

· WE CAN NOT ALLOW INDIVIDUALS WITH HIGH END EQUIPMENT TO SHOOT DURING CEREMONY AND FORMAL PHOTO SESSIONS AS THIS HAS A POTENTIAL TO CAUSE ISSUES WITH YOUR PHOTOGRAPHY AND INTERRUPTS OUR WORK FLOW

We understand and agree to the terms and conditions of this contract for wedding photography services and the attached addendums. (Both signatures are not required)
